The arbitrator's award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney's fees. Class Action Waiver
Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. Five Star Satellite LLC's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Five Star Satellite LLC's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by Five Star Satellite
LLC with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Five Star Satellite LLC with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Five Star Satellite LLC with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.
Limitation of Damages/LIMITED WARRANTY
In no event shall Five Star Satellite LLC be liable for consequential damages for breach of this warranty. Some States do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to the buyer.
Warranty Coverage
Five Star Satellite LLC warrants the Covered Product to be free of all defects in material and workmanship for 90 Days from the date of Original Purchase. This warranty extends to the original buyer (only or and each successive buyer within the warranty period). An extended warranty can be purchased for an additional fee. The extended warranty parallels the 90 day warranty and will include the same coverages and limitations.
Within the period of this 90 Day warranty, Five Star Satellite LLC will repair or replace, free of charge; any part proving defective in material or workmanship. All warranty repairs and service must be performed by Five Star Satellite LLC or an affiliate of Five Star Satellite LLC. All expenses related to replacing or repairing a defective part under this warranty shall be assumed by Five Star Satellite LLC. except for the following expenses, which shall be assumed by the buyer:

Misuse Damage
Abuse Damage
Warranty Exclusions
This warranty does not apply to any costs, repairs, or services for the following:
1. Service calls to correct the installation of the Covered Product, or to explain the usage of the product to the buyer.
2. Repairs necessitated by use other than normal home use.
3. Damage resulting from misuse, abuse, accidents, alterations, or improper installation.
4. Corrective work necessitated by repairs made by anyone other than a Five Star Satellite LLC authorized service technician or Five Star Satellite LLC affiliate.
How to Obtain Warranty Service
a. If warranty repairs are to be made:
The buyer must notify Five Star Satellite LLC by calling 775-338-0281 of any defect, malfunction, or nonconformity promptly upon discovery. If a replacement is deemed viable, a replacement will be sent out Standard UPS, Fedex or USPS to the customer within 5 business days. If determined necessary, only an authorized service technician shall visit the buyer's home for the purpose of repairing or replacing the defective part within 10 business days of receipt of the
If the buyer sends the product by U.S. mail, we recommend that the buyer insure it and send it return receipt requested. We accept no liability for products lost or misplaced in shipment.
(b) The buyer must return the Covered Product to the address of the Five Star Satellite LLC. Corp Offices.

(c) Once product is received, Five Star Satellite LLC. will do one of the following:
1. Service or repair the Covered Product to conform to the applicable warranty.
2. Replace the Covered Product with goods those are identical or reasonably equivalent to the warranted goods.
3. Refund to the buyer the original purchase price less that amount directly attributable to use by the buyer prior to the discovery of the nonconformity.
(d) Warranty Reimbursement
1. If an extended warranty is purchased , a reimbursement of the full warranty purchase will only be granted if the customer cancels within the 5 day grace period from the original purchase date.
2. No prorated warranties will be reimbursed after the 5 day grace period from original purchase date.

Notice to Buyer
This warranty gives you specific legal rights, and you may also have other rights which vary from state to state. You have the right to bring any action at law or equity to resolve disputes concerning or to enforce the provisions of this warranty.
If the buyer disagrees over either's performance under the terms of this warranty, the buyer may submit the matter for resolution to Five Star Satellite LLC. The buyer shall not be responsible for expenses incurred in submitting a dispute for resolution under the terms of this paragraph. The buyer is required to submit any dispute for resolution under this paragraph before pursuing any legal remedies to which he or she may be entitled.
